My AP is expering next month(NOV), I don't have any travel plans for next 1 year. i'm planing to apply in 2010 not now.

Who decides on the classification of an EB 2 or 3?
I have a masters degree and when filling my residency it was specify in the position, is it something my lawyer should have requested or Immigration decides when they receive the documentation?

I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.

I checked online in my bank and my uscis checks have passed for i-485,i-131,i-765. On the back of the checks, i found receipt numbers, I correctly took all receipt numbers and i entered them to my profile on uscis.gov website to track the processing, & !Surprise! i saw two receipt numbers referring to I-131and one to i-765 whereas none for i-485, Ideally, out of 3 receipt numbers, it should be one for each of i-485,i-131 & i-765??????? Don't know what to do? Has any one heard anything like that???????????????

I have been working with company A since december 2005 on my OPT.
Company A filed for my H1 that was approved and the start date for this
visa is december 1st 2006 (OPT expires december 15th, 2006). I am
talking to company B that wants me to join in november but is not sure
if they can file for a transfer before my visa begins. I have looked
around in various forums but havent found a satisfactory answer.
I have pay stubs from company A but, of course, they would be dated from
before the beginning of my visa. Can I use these for my transfer
application? Is transfer even possible in my case?

The Center for American Progress has released a report that urges an end to the "arbitrary restrictions" on H-1B visas and replacing the 65,000 quota with a market-based system where numbers rise in a strong economy and drop in a weak one. I had already gotten my USDOS approval and my USCIS approval for my J waiver. The whole process took less than a month which surprised us! But it was stated on the I-797 that I should start working for my employer within 90days from March 19, which will be June 19. The problem is my training program does not end until June 30. Even if I wait until June 19 to file for my H1B, and if I don't go for premium processing, once they approve it and retro-date it, there will be an overlap from June 19-30. Can I apply for the H1 on June 30 instead (when my J expires) but that will be more than 90 days from March 19? I will appreciate any suggestions. Thanks!
