My old friend Bernie Wolfsdorf is at this moment addressing the American Immigration Lawyers Association where he takes the helm as the 10,000+ organization's newest president. Bernie came here 30 years ago from South Africa and has built up a great immigration practice in Southern California. He leads the organization at a critical time. USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

I am applying for my H1B extension in apr 2009 for the start date of oct 1st 2009. I have been with the same client for the last 3 years. Following are my concerns:
My client doesn't give any reference letters as per their HR policy. But we have all contract docs/purchase orders from the client since oct 2006. The client extends the project only every 6 months and this has been happening since 3 years. But if USCIS asks a letter/contract which covers the entire contract period for which the H1B extension is requested, what are my options? Please let me know.

Hello,
I am on H1 B and wife is on H4. H1B is expiring in Nov 2009 and my employer is going to file for extn. My wife is currently doing her Masters on H4. Need some advise to here
1) If I apply for extn (H1 & H4) within next 2 weeks it will take atleast another 3 months before I will come to know the decision. Nowadays lot of H1B extensions are getting rejected. Will it be a good idea to move my wife's status to F1 and not apply for her H4 extn..?
or
2) Should I wait for my decision on extension and if it gets rejected then apply for F1
or
3) Apply both i.e. apply for extension and simultaneously for H4 to F1. Any issues with this approach?
I don't have constraints on paying fees on H4 or F1. All I want is my wife should be able to continue her studies. I am working in an Indian company, so even if my extn gets rejected, I will go back to and continue work, but still want my wife to continue studies.
Appreciate your help.

The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Risk Assessment Program Fraud Study: program is part of a study to help design profiles of potential fraud. Family-based petitions or employment-based petitions once approved are randomly selected.
Targeted Site Visits: this visit is to ask questions when fraud is suspected. Advance notice of visit is given.
Administrative Site Visits: for religious worker and H-1B programs. Specific questions generally regarding the beneficiary’s job duties as stated in the petition and whether the beneficiary is receiving the wage as stated on the petition.

Visitor's visa for my parents expired recently (it was a 5 yr VISA & they visited here 3 times and returned within 6 months each time) and they want to re-apply for a visa. My question is - Do I still need to send in the Document of Support, Employer and Bank letter or they can re-apply without these documents? On the safer side, I am sending the documents but in my view there should not be a need for the support documents...Anyone in similar boat?

Is core group out of mind...Sueing will waste our funds..
Please use this money for constructive tasks.
Since first day, if u have tried to make I485 filing w/o priority date current..
At least 90% of people wud have utilized AC21 and change employers.
Ofcourse you always convince the higher authorities, to let us file 485s and issue GC, when dates become current.
As long as we file 485 and utilize AC21, we will be in safe situation.
Have some plan and result oriented plan.
Thinking big is ok, but we shd know what actually we can do.

yes, you can add her anytime before the approval of your I485 (3rd stage of the GC process). You havent mentioned EB1/2/3 but if its EB2 or EB3, stage 3 is several years away for you, and you can always add her before you apply for the final stage. Good luck!

Recently i have joined a new employer after my H1 transfer has been applied, today i have recieved approval notice and its approved until October 15 2007,
were has my previous h1 was valid until October 2008. Please help how should i proceed ?

Hello,
this is a bit different maybe since it deals with my mom. She was sponsored by my sister. She has been stuck in name check now for about 18 monts. Anyways, she is out of the country. She just left, and now my sister got a letter and appoinment letter for a 2nd finger print. My mother is using her advacne parole and the green card was filed for adjustment of status.
so the questiong is can my sister reschedule the appointment 8 months in the future or can she change the location for finger print to the office in the country where my mother is,
She is in Pakistan right now.
