A friend of mine (Indian) is married to an Indonesian. Both are on H1B and have approved I-140s. Can my friend apply for a cross chargeability? Does it have to happen when my friends spouse's pd becomes current? or can it be done earlier?

The New York Times reports that tomorrow Immigration and Customs Enforcement will be sending instructions to agents in field offices aimed at changing their enforcement focus from work site raids that largely resulted in mass arrests of workers to I-9 audits and undercover investigations mainly targeting employers. However, workers will still be subject to arrest. According to the Times, the guidelines are partly a response to ICE's blindsiding DHS Secretary Napolitano with an unauthorized raid on a Bellingham, Washington mechanic's shop, which I discussed here.

Hi All,
I went for visa interview in December, but my case was stuck because of administrative processing. I came back on Advance parole. I have the following questions.
1. Can I sponsor my parents visitor visa without any issue? Will the consulate quiz them/stop them because of my H-1 admin processing
2. Also is my admin processing still going on? and can I stamp my H-1 visa in the future after my case is cleared from admin processing.

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. The masters cap usage this past week was 500 and the monthly average is 450. There are 3,800 H-1Bs left of 20,000 and I am projecting that cap will be exhausted in late December,...

I have to file for I-485 along with EAD and AP, I live in Phoenix and I am applying for 485 based on an approved I-140 based on NIW. Please let me know if I have to file in the Phoenix lockbox or send it to Nebraska.

I am on an O-1 visa married to a G-4 visa holder working for an international organization. My spouse's work told her recently that her spouse and other dependents have to be on a G-4 dependent visa unless they are a US citizen, green card holder or on their own G-4 visa.
1. If I change to G-4 spouse visa, I would have to wait 4-6 weeks before I get an EAD to work. So, I want to know if this is indeed true.
2. Can I continue to work on my O-1 until I get the EAD? Is there any way to expedite the EAD process.
3. Plus, I want to know about the portability of the EAD I can get through a G-4 visa.
4. Also, would this restrict my ability to apply for a green card in the future.
Thanks in advance for any replies.

One of the docs folks usually send is an employment letter from your new employer detailing the job duties, etc.
Most would give you this only after you join the new employer.
I don't think an offer letter with job duties would suffice.

Hi,
I am currently on H4 and had to file my H4 Extension as my current H4 was expiring. At the same time I also filed for H1B in 2008 and was picked up in the lottery. Now I am confused on which application the USCIS will consider.
Will it be H1B or H4?
If my H4 extension is approved after H1B will my status then becomes H4?
if H1B is approved after H4 will then the status becomes H1?
Is there a way that I can make sure the status at the end I have is H1B?

This is a standard response message which comes after USCIS receives the response to RFE and resumes case processing.
There is no way to determine when the case would be adjudicated and what will be the result. It could happen next week or take months.
